These Terms of Use govern your use of the website at ways.org.au (the “Website”) and the services we offer through it. The Website is operated by Waverley Action for Youth Services Inc (ABN 66 420 137 806), trading as WAYS Youth & Family (“WAYS”, “we” or “us”). By accessing or using the Website you agree to these Terms.
WAYS is a registered charity (ACNC since 03 December 2012), an endorsed Deductible Gift Recipient (DGR since 01 July 2000), and an endorsed Public Benevolent Institution. We are authorised to fundraise in New South Wales under the Charitable Fundraising Act 1991 (NSW) (Charitable Fundraising Authority CFN 14829).
You may use the Website to learn about WAYS, support our work, enrol in our services, apply to work or volunteer with us, and contact us. You agree to use the Website only for lawful purposes. You must not use the Website for any unlawful, fraudulent or harmful purpose, attempt to gain unauthorised access to any part of it, interfere with or disrupt it, or reproduce, sell or commercially exploit any part of it without our prior written consent.
You can donate to WAYS through our website at ways.org.au/donate/ or through our partner peer-to-peer fundraising platforms.
By making a donation you confirm that you are the authorised holder of the payment method used, you are 18 years or older (or are donating with the consent of a parent or guardian), and you understand that donations are voluntary gifts and are not made in exchange for any material benefit. Funds raised will be applied to our charitable purpose in accordance with the Charitable Fundraising Act 1991 (NSW).
If you set up a recurring (regular) donation, your nominated payment method will be charged the agreed amount at the agreed frequency until you cancel or change it. To cancel a recurring donation, please contact us at [email protected] or (02) 9365 2500 at least 10 clear business days before the next scheduled payment.
Donations are generally non-refundable as they are voluntary gifts. We will, however, consider a refund where the donation was processed in error (for example, a duplicate transaction or wrong amount), was made fraudulently, or where a refund is required by law. Refund requests should be sent to [email protected] within 14 days of the donation. A refunded donation is no longer eligible for a tax deduction and the related receipt should be securely destroyed.
Donations of $2 or more to WAYS are tax-deductible in Australia. WAYS is endorsed as a Deductible Gift Recipient under Subdivision 30-A of the Income Tax Assessment Act 1997. You will receive a receipt by email shortly after your donation. The receipt will include WAYS’ legal entity name, our ABN, the donation amount, the date, and the words “for a gift” as required by the Australian Taxation Office. Please retain receipts for your tax records.
The Website and its contents (including text, images, graphics, logos, video, audio, code and design) are owned by WAYS or used under licence, and are protected by Australian and international copyright, trade mark and other intellectual property laws. You may view, download and print pages for your personal, non-commercial use, provided you do not modify the content and you retain all copyright notices. Any other use requires our prior written consent.
The Website may contain links to third-party websites, services or content. These links are provided for your convenience. We do not endorse or accept responsibility for third-party content. Your use of third-party services is at your own risk and subject to the third party’s own terms and privacy policy.
The Website and its content are provided “as is”. To the maximum extent permitted by law we make no representations or warranties about the Website or its content, including warranties of accuracy, completeness, or that the Website will be uninterrupted, secure or free of errors. Information on the Website is provided for general information only and is not a substitute for professional advice.
Where any law (including the Australian Consumer Law in the Competition and Consumer Act 2010 (Cth)) implies a guarantee that cannot be lawfully excluded, our liability for breach of that guarantee is limited, to the extent permitted by law, to either resupplying the relevant service or paying the cost of having it resupplied. To the maximum extent permitted by law we exclude liability for any indirect or consequential loss arising out of your use of, or inability to use, the Website.
WAYS holds public and products liability and professional indemnity insurance appropriate to the services we deliver.
We handle personal information in accordance with our Privacy Policy. By using the Website you acknowledge that you have read and understood that policy.
We may update these Terms from time to time. Updated terms will be published on this page with the “Last updated” date amended. Your continued use of the Website after a change takes effect constitutes your acceptance of the updated terms.
These Terms are governed by the laws of New South Wales, Australia. You and WAYS submit to the non-exclusive jurisdiction of the courts of New South Wales.
